Today, April 1, marked the first day that U.S. Citizenship & Immigration Services (USCIS) would accept H-1B petitions for fiscal year 2009. Rosner Partners filed nearly all of the firm's cap-subject filings yesterday, reserving only those requiring additional information and documentation for subsequent filing. It is expected that, like last year, the number of H-1B filings for the 2009 fiscal year will far outstrip the available visa numbers, resulting in a lottery-selection process to determine how USCIS will allocate H-1B numbers.
USCIS has announced that all petitions filed within the first five business days will be treated equally for the purposes of the H-1B lottery. Therefore, if any client has outstanding materials to provide to us in connection with an H-1B petition, or is interested in hiring a new H-1B employee for an H-1B start date of October 1, 2008, there is still time to provide us with the necessary information and documentation to files these cases! If you are interested in hiring a new H-1B employee or owe us material necessary to file your existing matter, please contact us immediately. H-1B filings must be submitted to USCIS no later than Friday, April 4.
